We’re based in Hamilton, New Zealand. All our agreements and services are governed by the laws of Aotearoa New Zealand.
BY GETTING STARTED ON A PROJECT WITH US, PAYING AN INVOICE, OR BUYING SOMETHING FROM OUR ONLINE SHOP, YOU’RE AGREEING TO THESE TERMS.
If you’re working with us on a custom project, we’ll send you a proposal/contract outlining deliverables, timeline, and pricing specific to your project.
While this page acts as our master agreement covering the rules for working together, your individual contract outweights what’s on this page if they ever conflict.
The content, images, designs, and text across eminent.nz and shop.eminent.nz are created by Eminent Design Studio and belong to us unless specifically stated otherwise.
You agree not to misuse our site, try to hack our network, or introduce any dodgy code or malware to our servers.
We do what we can to ensure all information, project examples, and shop listings on our site are up-to-date. However, technology is a marvel until it doesn’t want to work, so we can’t guarantee that everything on the site will be 100% free of errors or live all of the time.
To put your project into our calendar, we send you a Project Starter Invoice (deposit) as part of our Project Welcome Guide before any work begins. This invoice covers initial setup time, research, scheduling, and early concept work.
Because this fee covers upfront costs and time, PROJECT STARTER INVOICES ARE NON-REFUNDABLE ONCE THEY’RE PAID AND WORK HAS BEGUN.
We want to be sure you absolutely love the end result. Custom projects include two (2) free rounds of revisions after the initial final draft.
Note: A revision round means taking your collected feedback on that draft and tweaking details like colours, fonts, copy adjustments, or minor layout changes. The two free revision rounds exclude the round of changes after the initial final draft.
Don’t worry if you need a few additional changes, we have you covered:
We create your designs around the scope we agree on together before the project starts, and we understand that circumstances can shift and minds can change. However, if you decide to make major structural changes AFTER THE THIRD ROUND OF REVISIONSÂ this incurs an extra fee equal to 50% of your Project Starter Invoice.
Note: Major structural changes include, but aren’t limited to, a completely new layout, a different colour direction, or adding whole new pages or features that weren’t in the original Project Overview.
Any requests for structural changes after payment of the Project Completion Invoice will require starting a new project.
Under New Zealand copyright law, all working drafts, concept proofs, and final designs remain the property of Eminent Design Studio until the Project Completion Invoice is paid in full.
Technology is constantly changing, so we have clear rules around AI and your design work. USE OF AI BEFORE THE PROJECT IS COMPLETED IS STRICTLY OFF-LIMITS. You are prohibited from uploading, training, feeding, or processing any of our draft designs or concepts into AI models or generators (like Midjourney, ChatGPT, vector generators, or scraping tools) before the project is fully paid for. This protects the copyright of the project.
ONCE THE PROJECT COMPLETION INVOICE IS CLEARED, FULL COPYRIGHT OWNERSHIP OF THE FINAL APPROVED DELIVERABLES TRANSFERS TO YOU!
At that point you’re completely free to do whatever you like with the final files. Including uploading them to AI, modifying them, or registering trademarks.
We’re proud of the work we do with awesome Kiwi businesses, and we want to show off. Unless we’ve signed a specific Non-Disclosure Agreement (NDA) with you before starting, Eminent Design Studio reserves the right to feature the completed project in our showcase and social media.
We know running a small business can get hectic quickly. To keep the project moving forward and running smoothly for everyone we need regular communication and updates from you.
If a project stalls because we haven’t heard back from you regarding content, feedback, or approval:
If time does slip away from you and your project gets cancelled, you can request a project restart within 3 months from the cancellation date. To restart your project, you’ll need to pay a Project Restart Fee equal to 50% of your original Project Starter Invoice. This covers project double handling and calendar rescheduling.Â
In the unfortunate situation we don’t hear from you within the 3 months of your project being cancelled, meaning 6 months of total inactivity from our 2nd attempt to contact you, your project will be permanently archived and closed.
Archived projects cannot be restarted under the original agreement or pricing. If you want to start your project back up at a later date, you’ll need to start a whole new project, with a new contract and Project Starter Invoice.
We offer website hosting to give you a fast, reliable, and secure home on the internet. Hosting plans are billed on a monthly or yearly basis and cover your server, domain management, SSL security certificates, and core email routing setup.
While we use high-quality, professional hosting platforms, no server is 100% guaranteed to stay live. Eminent Design Studio is not held liable for any unexpected website downtime, server outages, hardware glitches, or cyber incidents caused by third-party hosting providers.
WHAT MAINTENANCE COVERS:
If you’re on one of our website maintenance plans, we take care of back-end upkeep. Making sure your website core, tools, and plugins are updated, along with security monitoring and database backups.
WHAT MAINTENANCE DOESN’T COVER:
Maintenance plans do not include adding new site content, tweaking layouts, creating new pages, or structural redesigns unless those services are explicitly written into a custom support retainer contract with you.
With our hosting services, you’re never locked in. You can request to stop your hosting service with us at any time. If you decide to move your site somewhere else, we will be more than happy to transfer your website to a different host at no extra cost, provided you have the correct credentials for the transfer.
Because our merch products are printed on-demand when you order, our policies operate slightly differently from traditional stores.Â
CURRENCY:Â Since we’re located in beautiful Aotearoa, all prices listed across our store are in New Zealand Dollars (NZD).
PRICES EXCLUDE GST: Because we currently don’t make over the threshold needed to pay GST, we can’t collect it, so you don’t pay it.
BUILT-IN SHIPPING:Â To keep checkout simple, we’ve added standard shipping costs into the price of the product. Meaning what you see on the product page is what you pay at checkout.
IMPORT DUTIES:Â Due to our suppliers’ locations, orders over $1000 (NZD) may be subject to local taxes or customs duties.Â
Our products are currently supplied through Printify and are print-to-order. Therefore, this affects our ability to do certain returns.
CHANGE OF MIND: Due to our products being custom-made to order, we cannot accept returns, refunds, or exchanges if you change your mind, pick the wrong size, or order the wrong colour.
SIZING CHECK:Â Please check the size guide on our products to make sure you get the right fit.
Sometimes, despite everything, you could be delivered a lemon. If something arrives damaged, misprinted, or isn’t what you ordered, we’ll fix it with a free replacement or full refund.
Nothing in our policies overrides your rights under the New Zealand Consumer Guarantees Act 1993. If an item is genuinely faulty or not as advertised, we will always make it right.
We know that trusting us with your personal information is a big deal. Eminent Design Studio is committed to keeping your data safe and secure across all aspects of our business in accordance with the New Zealand Privacy Act 2020.
