Introduction
These terms and conditions outline the policies and procedures governing our services, including website design, branding, hosting, graphic design, and products listed on shop.eminent.nz. By purchasing through Eminent Design Studio, you agree to the following terms regarding payments, revisions, intellectual property, cancellations, and liability.
Payment Terms
- All invoices must be paid within 30 days from the issue date.
- Failure to pay within the 30-day period incurs a late fee of 25% of the total project cost.
- Payments are accepted via bank transfer. E-commerce payment for projects are available on request.
Refund Policy
- Refunds cannot be issued for hosting and service-related disputes, as funds are allocated to third-party services.
- Clients may request an immediate stop to hosting services, and we will transfer their website to another server at no cost.
Design & Revision Policy
Standard Revisions:
- Clients receive two free revisions after the final draft submission.
- Additional revisions cost $50 per revision, with $25 per extra element changed beyond the scope of one element of the project.
Major Changes Policy:
- Major website modifications requested after the third draft will incur an additional fee of 50% of the Project Starter Invoice.
- Any structural changes after project finalisation may require a new agreement or separate service fee.
Intellectual Property (IP) Rights
- Upon completion and full payment of the Project Completion Invoice, the client gains full ownership of the final project design.
- If the client fails to finalise the project but wishes to retain the designs, they must pay the Project Completion Invoice release fee to receive the IP rights.
- Regardless of ownership transfer, Eminent Design Studio retains the right to use completed work for marketing and promotional purposes unless otherwise agreed in writing.
- Unauthorised use of designs without payment is considered theft and will be pursued accordingly.
Hosting & Support
- Hosting services are available at monthly or yearly rates, covering server costs, domains, emails, and security.
- Eminent Design Studio is not liable for any downtime or failures caused by third-party hosting providers.
- Website maintenance plans include security updates and general upkeep but do not cover content updates unless explicitly stated.
Project Cancellation & Restart Policy
Communication & Cancellation Timeline:
- If Eminent Design Studio fails to receive a response after five contact attempts within a three-month period, the project will be deemed cancelled. The three-month period begins with the 2nd attempt at communication between us and the client.
- Clients then have three months from the date of cancellation to restart the project. Clients will be required to pay the restart fee (50% of the Project Starter Invoice) upon their project being restarted.
- If no restart request is received by the within three months of cancellation, the project will be archived and no longer eligible for restart under the original agreement.
- After six months of total inactivity, the project is considered closed, and clients must submit a new quote request form to begin a fresh project from the start.
Liability & Limitations
- Eminent Design Studio is not responsible for losses incurred by third-party providers, including hosting platforms.
- We are not liable for damages resulting from misuse or unauthorised modification of our designs.
- Clients are responsible for providing accurate materials and information required for the project.
Agreement Acceptance
- By beginning a project with Eminent Design Studio or purchasing a product from shop.eminent.nz, the client agrees to these terms and conditions.
